Terms of service

1.Who we are

In these terms, "we", "us" and "Foxwork" mean Kitefox SRL. "You" means whoever is using our website or our services.

2.What these terms cover

These terms apply to:

• This website, www.foxwork.ai.
• Foxwork, our recruitment service, which advertises vacancies for employers, collects applications from candidates, and helps recruiters assess them.

By using either, you accept these terms. If you do not accept them, do not use the service.

Where we have signed a separate written contract with you, that contract wins over these terms on anything the two disagree about.

3.Using this website

You may read this website and contact us through it. You may not:

• Attempt to gain access to any part of it you were not granted.
• Scrape it, or extract data from it in bulk, by automated means.
• Interfere with its operation, or attempt to disrupt it for other users.
• Use it to send anything unlawful, misleading, or abusive.

4.The Foxwork service

4.1 If you are a candidate

• Applying is free. We never charge candidates.
• You must be legally entitled to work in the country the vacancy is in. We do not check this for you, and it is not our responsibility to.
• Give us accurate information. A CV or an answer that misrepresents your experience may lead us to withdraw your application.
• Applying is not an offer of employment, and nothing here promises you an interview, a reply, or a job. The hiring decision belongs to the employer.
• You keep every right you already have over your own personal data. How we handle it is in our privacy policy.

4.2 If you are an employer or a recruiter

• You are responsible for what you publish: the accuracy of the vacancy, and that it is lawful and non-discriminatory under Belgian and EU employment law.
• You must have the authority to advertise the role you are advertising.
• You become a separate data controller for the candidate data we pass to you, and you are responsible for handling it lawfully from that point on, including answering candidates who exercise their rights against you.
• You may use candidate data only to assess that candidate for the vacancy they applied to. You may not resell it, add it to an unrelated database, or market to it.
• Where we advertise a vacancy on your behalf on third-party platforms, their own advertising policies apply on top of these terms, and a platform may refuse or remove an ad for reasons outside our control.

5.Accounts

Some parts of the service need an account. Keep your credentials to yourself, do not share a login, and tell us at info@kitefox.com as soon as you think an account has been compromised. You are responsible for what happens under your account until you tell us.

6.Paid plans and billing

• Candidates never pay. This section is for employers only.
• Where a paid plan applies, the price, the billing cycle and what the plan includes are those shown to you at the point of purchase. That is what you are agreeing to.
• Prices are in euro and exclude VAT unless stated otherwise. VAT is applied at the applicable Belgian or EU rate.
• Payment is due on the terms shown at purchase. We may suspend a service that is unpaid after we have told you and given you a reasonable chance to settle.
• Advertising spend on a third-party platform is separate from any fee payable to us, unless we have agreed otherwise in writing.
• Business customers have no statutory right of withdrawal for a service already delivered. Consumer rights, where they apply, are unaffected by this clause.

7.AI-generated content

Foxwork uses AI models to draft job descriptions, generate images for advertising, and assess applications against a vacancy. Two things follow from that.

• Check what it writes. AI output can be wrong or incomplete. Where we generate text or an image for your vacancy, you are responsible for reviewing it before it is published under your name.
• A score is not a decision. Candidate assessments are decision support for a human recruiter. We do not make hiring decisions by automated means alone, and you should not either. Section 6 of our privacy policy explains this in more detail, including the right to ask for human review.

8.Content and intellectual property

• The website, the Foxwork software, and everything we built into them stay ours. Nothing in these terms transfers our intellectual property to you.
• What you upload stays yours. You give us the permission we need to host it, process it, and show it to the intended recipient, for as long as we are providing the service.
• Do not upload anything you do not have the right to upload.

9.Availability

We work to keep the service running, but we do not promise it will be uninterrupted or error-free. We may take it down for maintenance, and we may change or withdraw features. Where a change materially reduces what a paying customer receives, we will tell them in advance.

10.Liability

Nothing in these terms limits liability that cannot be limited under Belgian law, including liability for fraud, for wilful misconduct, or for death or personal injury caused by our negligence.

Subject to that:

• We are not liable for indirect or consequential loss, for lost profit, lost business, lost data, or for a vacancy that fails to attract the candidates you hoped for.
• Our total liability to a paying customer, for all claims arising in any twelve-month period, is limited to the amount that customer paid us in that period.
• We are not responsible for what an employer does with a candidate's application after we hand it over, nor for what a third-party advertising platform does with an ad.

11.Suspension and termination

You may stop using the service at any time. We may suspend or close an account that breaches these terms, that is used unlawfully, or that puts other users or the service at risk. Where circumstances allow, we will tell you first and give you a chance to put it right.

On termination we delete or return data in line with the retention periods in our privacy policy.

12.Privacy

How we handle personal data is set out in our privacy policy, which forms part of these terms. It covers what we collect, why, who we share it with, how long we keep it, and how to have it deleted.

13.Changes to these terms

We update these terms when the service changes. The date at the top shows the current version. Where a change materially affects a paying customer, we will tell them directly before it takes effect. Continuing to use the service after a change means you accept it.

14.Governing law and jurisdiction

These terms are governed by Belgian law. Any dispute goes to the courts of Walloon Brabant, Belgium, unless a mandatory rule of law gives you the right to bring it somewhere else. We would always rather sort it out by talking to you first, so write to us before you do anything more expensive.
